IF YOU SCANNED YOUR FINGER IN COMPACT INDUSTRIES, INC.’S TIMEKEEPING SYSTEM IN ILLINOIS BETWEEN OCTOBER 27, 2017 AND JULY 6, 2023 WITHOUT FIRST EXECUTING A WRITTEN CONSENT, YOU MAY BE ENTITLED TO A PAYMENT FROM A CLASS ACTION SETTLEMENT.
The Court authorized notice of a proposed settlement in a class action lawsuit entitled Reyes v. Compact Industries, Inc. Case Number 2022CH10640, that is pending in Cook County, Illinois (“Lawsuit”). The settlement would resolve the Lawsuit brought on behalf of the Settlement Class.
Class Members identified through Defendant’s records as a Settlement Class Member received notice of the Settlement by mail. For purposes of settlement only, the Court conditionally certified the following Settlement Class: All individuals whose biometrics were collected, possessed, disclosed, captured, obtained or stored by Compact Industries Inc. within the State of Illinois between October 27, 2017 to July 6, 2023, without first executing a written consent.
The named plaintiff, Jose Reyes (“Plaintiff”), filed a class action lawsuit alleging that Compact Industries, Inc. (“Defendant”) collected its employees’ fingerprints without making the disclosures and receiving the written consent required by the Illinois Biometric Information Privacy Act, 740 ILCS 14/1, et seq. (“BIPA”).
Defendant denied and continues to deny Plaintiff’s allegations. Notwithstanding their disagreements, the parties have proposed a settlement that, if approved by the Court, will resolve the Settlement Class’ claims relating to the collection of biometric information.
YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT | ||
ASK TO BE EXCLUDED FROM THE CLASS BY OCTOBER 4, 2023 | If you choose to exclude yourself (opt out), you will not be included in the Settlement. You will receive no benefits and you will not release any claims you may have against Defendant regarding the allegations in this case ever again. | |
OBJECT BY OCTOBER 4, 2023 | If you wish to object to the Settlement, you must file your objection in writing with the Clerk of the Court, and send a copy of your objection to the attorneys for all Parties. If you exclude yourself from the Settlement, you cannot file an objection. Settlement Class Members who do not timely make their objections in this manner will be deemed to have waived all objections and shall not be heard or have the right to appeal approval of the Settlement. If you file an objection and wish it to be considered, you must also appear at the Final Approval Hearing, in-person or through counsel, to show cause of why the proposed Settlement should not be approved as fair, reasonable, and adequate. | |
DO NOTHING | If you want to participate in the settlement and receive a settlement payment, do nothing. A check will be mailed to you if the Court grants final approval of the settlement. If you do nothing, you will stay in the Settlement Class, be bound by any judgment entered by the Court, and you will release your claims against Defendant about collection of your biometric information. |
